Terms and Conditions

1. Scope

These Terms and Conditions (“Terms”) govern all use of vectorize.graphics (“Service”, “Site”) operated by Example Company GmbH, Example Street 1, 12345 Sample City, Germany (“we”, “us”). By accessing or using the Service you agree to be bound by these Terms and by our Privacy Policy.

2. Definitions

“Raster Image” – PNG, JPEG or comparable bitmap file you upload.
“Vector Output” – SVG or other vector file generated by the Service.
“User” – any natural or legal person accessing the Service.

3. Description of the Service

The Service provides an automated conversion of Raster Images into Vector Output. Processing is fully automated and no manual quality assurance is included unless expressly offered under a separate contract.

4. User Obligations & Content Rights

You warrant that you own, or have secured, all necessary intellectual-property rights and licences to lawfully upload the Raster Image.
You grant us a non-exclusive, royalty-free licence to process the Raster Image solely for the purpose of generating the Vector Output. The licence ends automatically when we delete the Raster Image (see Section 9).
You must not upload content that is illegal under German or EU law, including but not limited to hate speech (§ 130 StGB), child sexual abuse material or copyrighted works without permission.

5. Fees

Unless otherwise stated, the Service is offered free of charge. We reserve the right to introduce premium features or pricing in the future; any change will be announced in advance and will not retroactively affect concluded transactions.

6. Right of Withdrawal (EU Consumers)

If you are an EU consumer and purchase a paid digital service, you have a 14-day statutory right of withdrawal. However, the right expires once:

the service has been fully performed, and
you have expressly consented to us starting performance before the 14-day period ends and acknowledged that you will lose the right of withdrawal once the contract is fully performed (Art. 16 (m) Consumer Rights Directive).

7. Availability & Support

We endeavour to provide uninterrupted access but do not guarantee any specific uptime. Planned maintenance and updates may result in temporary downtime. Support is provided on a best-effort basis via support@vectorize.graphics.

8. Intellectual Property in the Service

The Site, source code, branding and all intellectual property other than user-provided content remain the exclusive property of Example Company GmbH or its licensors.

9. Data Retention & Deletion

Raster Images are deleted automatically within 24 hours after processing. Vector Output may be cached for up to 30 days to enable re-download but can be deleted earlier upon request.

10. Liability

The Service is provided “as is”. We make no warranties—express or implied—regarding the accuracy, fitness for a particular purpose or non-infringement of the Vector Output.
We are liable without limitation for intent and gross negligence and for injury to life, limb or health. For ordinary negligence we are liable only for breaches of essential contractual duties, and such liability is limited to foreseeable damages typical for this type of contract (Art. 276 BGB).
Liability under the German Product Liability Act (ProdHaftG) remains unaffected.

11. Indemnification

You agree to indemnify and hold us harmless from any third-party claim arising from or related to your breach of these Terms, including any violation of intellectual-property rights.

12. Governing Law & Jurisdiction

These Terms are governed by German law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a merchant, a public-law entity or a special fund under public law, the exclusive place of jurisdiction is Sample City, Germany. Mandatory consumer protection provisions of your home EU member state remain unaffected.

13. Online Dispute Resolution

The European Commission provides an ODR platform at ec.europa.eu/consumers/odr/. We are neither obliged nor willing to participate in dispute-settlement proceedings before a consumer arbitration board.

14. Amendments

We may modify these Terms to reflect legal, technical or business changes. We will notify registered users at least 14 days before changes take effect. Continued use after the effective date constitutes acceptance of the revised Terms.
